Who Needs MSHA Part 46 New Miner General Safety and Health Training?
This training is required for:
- New miners who are starting work for the first time at a surface mine covered by 30 CFR Part 46.
- Contractors and independent contractors who perform work on Part 46 mine sites.
- Individuals working at surface mines that produce sand, gravel, surface stone, surface clay, colloidal phosphate, or surface limestone.
NOTE: This course does not apply to underground or coal mining operations, which are regulated separately under 30 CFR Part 48.

Once you complete the required 24 hours of MSHA Part 46 New Miner Training, your certificate does not expire. However, to stay compliant, miners must complete at least 8 hours of Annual Refresher Training every 12 months. Failing to complete the refresher training within the yearly cycle may result in noncompliance with MSHA regulations.
According to 30 CFR §46.8, every miner must complete a minimum of 8 hours of refresher training once every 12 months. This training reviews key safety and health topics, updates on new hazards, and reinforces emergency procedures to ensure miners stay current on safe work practices.

Part 46 applies to surface mining operations such as sand, gravel, limestone, and clay.
Part 48 applies to underground mining and surface mining of metal and coal.
Training under one part does not substitute for the other — miners must complete the program that applies to their specific type of operation.
Under §46.3 and §46.12, the mine operator or independent contractor is responsible for developing and implementing a written training plan and ensuring that all miners receive and document their required training.
If annual refresher training is not completed on time, the miner is considered out of compliance and must complete the required training before returning to work at the mine. The operator must also maintain accurate training records to demonstrate compliance during MSHA inspections.
